Gatekeeper Improvement Act
The Gatekeeper Improvement Act imposes obligations on both employers and employees during the first two years of illness.
Objective of the Act
The act aims to prevent long-term incapacity for work by promoting intensive reintegration.
Employer Responsibilities
- Engage an occupational health physician
- Prepare a problem analysis (week 6)
- Develop an action plan (week 8)
- Maintain a reintegration report
- Offer suitable work
- Initiate a second-track trajectory if necessary
Employee Responsibilities
- Cooperate in recovery and reintegration
- Accept offered suitable work
- Share relevant information
- Attend appointments with the occupational health physician
Assessment by the UWV (Gatekeeper Test)
During a WIA (Work and Income according to Labour Capacity) application, the UWV (Employee Insurance Agency) verifies whether both parties have sufficiently contributed to reintegration.
Possible Sanctions
- Employer: wage sanction (additional year of wage payment)
- Employee: reduction in or denial of WIA benefits
