WW Entitlement After Dismissal: Conditions, Application and Calculation in Westland

If you live in Westland and lose your job, you may face uncertainties about your income. The Unemployment Act (WW) provides a temporary safety net for employees who become involuntarily unemployed. In this article, we discuss what WW entitlement entails, the conditions you must meet, how to apply for a WW benefit and how its amount is determined.

What does the Unemployment Act (WW) entail?

The Unemployment Act is a Dutch social insurance scheme that protects employees against loss of income in the event of unemployment. If you lose your job without it being your fault, you may be eligible for a WW benefit under specific conditions via the UWV. This benefit provides you with financial support while you actively seek new employment.

The WW has a dual purpose: it provides financial stability to the unemployed and motivates them at the same time to return to work as soon as possible. During the benefit period, you are obliged to apply for jobs and participate in reintegration programmes.

Conditions for a WW Benefit After Dismissal

To be eligible for WW in Westland, you must meet a number of criteria. It is advisable to review these carefully before submitting an application.

Unemployment Not Attributable to Yourself

A crucial condition is that your unemployment must not be attributable to yourself. You are entitled to WW in situations such as:

  • Dismissal by the employer: For example, due to economic circumstances or a reorganisation.
  • End of fixed-term contract: If your contract is not extended.
  • Termination via the cantonal court: When the court terminates your employment contract at the employer's request.

You are not entitled to WW if:

  • You resign yourself without a valid reason.
  • You are dismissed due to blameworthy conduct, such as misconduct or fraud.
  • You receive a high severance payment that exceeds your WW entitlement.

Employment History: Weekly Requirement and Reference Requirement

In addition to involuntary unemployment, you must meet requirements regarding your employment history:

Weekly requirement: You must have worked in at least 26 of the 36 weeks prior to your unemployment.
Reference requirement: In the 36 weeks prior to your first day of unemployment, you must have worked at least 208 hours, which amounts to approximately 52 days for a full-time job.

Availability for Work

You must be immediately available for the labour market. This means that you:

  • Actively seek suitable employment.
  • Keep track of and report job applications.
  • Cooperate with reintegration activities.
  • Have no impediments to accepting work, unless medically established otherwise.

Registration as Job Seeker

Within one week after the end of your employment contract, you must register as a job seeker with the UWV. This is an important first step for your WW application.

How to Apply for a WW Benefit in Westland?

Applying for a WW benefit follows a number of clear steps. Ensure you complete this process in a timely and correct manner to avoid delays.

Step 1: Register as Job Seeker

Register as a job seeker with the UWV no later than one week after the end of your contract. This can be done easily online via the UWV website or by telephone.

Step 2: Apply for WW Benefit

After your registration, you can apply for a WW benefit via your personal UWV account. You must provide details such as:

  • Your personal information and BSN.
  • Information about your previous employer.
  • Documents such as your employment contract and dismissal letter.
  • Your bank account number for the payment.

Step 3: Submit Documents

The UWV requests additional documents, such as:

  • A copy of your employment contract.
  • The dismissal letter or termination agreement.
  • Recent payslips.

Step 4: UWV Decision

Within four weeks, you will receive a decision from the UWV. During this period, the UWV may request additional information. Upon approval, you will receive an overview of the amount and duration of your benefit.

Calculation of the WW Benefit

The amount of your WW benefit is calculated on the basis of your last earned salary, with a maximum limit. For more information on the exact calculation, you can contact the UWV or the Juridisch Loket Westland for legal support.
